At present, IPR protection has become one of China’s national strategies. Since reform and opening up, especially in recent years, great achievements gained in China’s IPR protection work.
1, IPR protection legal system ever-increasingly perfect
Over 20 years of development, China has set up and completed IPR protection laws and regulations in various forms, such as law, administrative rules, government and department regulations and judicial explanation. Besides special laws like patent law, trademark law, copyright law and the implementing detailed rules and corresponding rules, there are also laws engaged with IPR chapter and items like criminal law, contract law and anti-unfair competition law.
2, IPR law enforcement enhanced continuously
According to the framework of such international conventions and regulations as WTO’s Agreement on Trade-Related Aspects of Intellectual Property Rights China implements administrative and judicial protection. And IPR protection work group is set up to strengthen guidance and coordination.
On Apr 1, 2007, the work group issued China’s Action Plan on IPR Protection 2007 which engaged with 10 contents and 276 specific measures in legislation and execution. China’s IPR law enforcement will be enhanced continuously, so that all infringement will be cracked down bitterly.
3, IPR international cooperation deepened
While keeping perfecting domestic legal system’s development, China took part in a series of important IPR protection international convention, regulation and agreement starting from 1980s in succession.
China vigorously participated in international IPR protection reform and negotiation, and kept strengthening bilateral IPR cooperation with such international organizations like WTO, WIPO, UPOV, APEC and ASEM. China set up IPR work group with US and EU respectively and held meetings periodically. China set up IPR exchange mechanism with Japan, ROK, ASEAN, Germany, UK, Austria, Spain, Swiss, Russia, New Zealand and Hong Kong.
China did a lot of work in legislation and execution which in turn met the relatively high requirements of TRIPS, which is recognized generally by international society.
Chinese government is committed to set up a more perfect IPR protection system through arduous and careful work, and long unremitting effort. China was willing to cooperate broadly with all countries and international organizations in IPR protection with enthusiasm, jointly made effort, promoted a favorable system and atmosphere of respecting knowledge and science in the world, and contributed to the world.
